the intensity, frequency and tunes of occurrence of noise, being greater than the evaluation so specified by Ordinances of the Ministry of Transport.
(Objects of Compensation for Removal, etc.)
Article 7. The compensation under the provisions of Article 9 paragraph 1 (Compensation for Removal, etc.) of the Law shall apply only in the case of standing trees or bamboos integral to the land associated with a building, on land situated in an area other than a third class area under the provisions of Article 9- (2)paragraph 1 (Maintenance of Green belt, etc.) within a second class area under the provisions of Article 9 paragraph 1 of the Law.
(Land to be Eligible for Purchase)
Article 8. The purchase of land under the provisions of Article 9 paragraph 2 (Purchase of Land) may be performed only in cases falling under either of the following provisions, to any land existing in an area other than a third class area under the provisions of Article 9-(2) paragraph 1 (Maintenance of Green Belt, etc.), in a second class area under the provisions of Article 9 paragraph 1 (Compensation for Removal, etc.) of the Law:
(1)Housing Lots (only for those area regarded as housing lots in the case of designation under the provisions of Article 9 paragraph 1);
(2)Lands belonging to any person who is eligible for compensation under the provisions of Article 9 paragraph 1 (Compensation for Removal, etc.) who has found it difficult to continue customary use of the lands in his possession (excluding that specified in the preceding subparagraph) other than on which said object exists.
(Facilities in reference to Gratis Use of Land)
Article 8-(2). The facilities as specified by Cabinet Order under Article 10 paragraph 2 of the Law concerning Special Measurement of Aircraft Noise around Designated Airports (Law No. 26, 1978) shall be the same as those listed in each subparagraph of Article 9 of the Cabinet Order relating to the Enforcement of Law concerning Special Measurement of Aircraft Noise around Designated Airports (Law No. 355, 1978).
(Business Eligible for Compensation of Loss)
Article 9. The business to be specified by Cabinet Order under the provisions of paragraph 1 of Article 10 of the Law shall be the businesses related to the fishing industry.
(Loss which shall be Eligible for Compensation)
Article 10. The losses to be compensated for under the provisions of Article 10 paragraph 1 (Compensation of Loss) of the Law shall be the loss suffered in cases where agriculture or fishing is performed in an area which coincides with the
